Premises Liability vs. Slip and Fall: What’s the Difference?

If you’ve been injured on someone else’s property, you may have heard the terms “premises liability” and “slip and fall” used interchangeably. While these concepts are related, they are not the same. At All Day Law, APC, we help individuals across Orange County understand their legal rights and seek compensation when they’ve been injured due to property owner negligence.

Understanding Premises Liability

Premises liability is a broad legal concept that holds property owners responsible for maintaining reasonably safe conditions on their premises. When they fail to do so and someone is injured as a result, the injured person may have a valid premises liability claim. Common examples of premises liability cases include:

  • Slip and fall accidents
  • Inadequate lighting in stairwells
  • Broken handrails
  • Dog bites
  • Swimming pool accidents
  • Falling merchandise in stores

To pursue a successful claim, the injured party typically must prove that the property owner knew or should have known about the hazardous condition and failed to take appropriate action.

What Is a Slip and Fall?

A slip and fall is one type of incident that falls under the umbrella of premises liability. It occurs when a person slips, trips, or falls due to a dangerous condition on someone else's property—such as:

  • Wet floors without warning signs
  • Uneven sidewalks
  • Spilled food or liquids in grocery stores
  • Loose rugs or mats in entryways

Although slip and falls are common, proving liability can be complex. It’s not enough to simply show that you fell; you must show that the property owner was negligent in maintaining the premises.

The Key Differences

While slip and fall cases are a type of premises liability, not all premises liability claims involve slips or falls. The main difference lies in the nature of the accident. Slip and fall claims specifically involve falling injuries, while premises liability encompasses a wider range of incidents that can occur due to unsafe property conditions.
